Families have a right to an independent evaluation at the school's expense IF:
- the school agrees
- the independent evaluation is a follow-up to one the school has already done
- the school accepts any of the findings of an evaluation a family has already sought and financed
Independent means independent from the school system
the evaluator is NOT picked by the school system
the evaluator is NOT picked by the school system in conjunction with the parents
parents have a right to pick their own evaluator
The school must take the family to hearing for the right to:
- refuse a follow-up independent evaluation
The school is not bound to accept the findings of the independent evaluation
arbitrartion can be sought through mediation or hearing
Rights to an independent evaluation refer to each form of evaluation:
psychological, educational, speech and language, assistive technology, related services
(Occupational Therapy, Physical Therapy)
